Abstract

Проаналізовано правове забезпечення та основні показники проведення земельних торгів в Україні, зокрема на землях сільськогосподарського призначення, пріоритетність використання яких визначено Земельним кодексом України. Надано основні напрями вдосконалення процедури проведення земельних торгів.

The legal support and the main indicators of land auctions in Ukraine, in particular on agricultural lands, the priority of which is determined by the Land Code of Ukraine are analyzed. The main directions of improving the procedure of land auctions are given. Key words: land auctions, auctions, electronic land auctions, agricultural lands. The purpose of the article is to analyze the current state of legal support for land auctions for the sale of ownership or land use rights (lease, emphyteusis, superficies), which are held in the form of an auction, providing recommendations for improving the auction procedure. The methodological basis of the study is a set of methods of scientific knowledge, namely logical, system-structural and others. We suggest that the website of the State Geocadastre of Ukraine in the section on land auctions include information on each lot, the right of use or ownership of which is put up for sale, regarding the list of land auctioneers in order to verify the existence of real competition between them. This will increase the transparency of the land auction procedure and will allow to form a real price for the sale of ownership or use of land. It is necessary to legislate the minimum time for signing the protocol of land auctions to 1 day to avoid delaying the procedure.
