Права людини: четверте покоління

Abstract

Розкрито поняття покоління прав людини, конкретно-історичні умови формування та критерії класифікації поколінь прав людини. Описано поняття та сутність прав людини четвертого покоління. Показано, що в основі їх полягає незалежність особи у виборі правомірної поведінки, яка базується на автономії людини у межах єдиного правового поля, норм моралі та релігії. Визначено, що права людини четвертого покоління можна звести до двох загальних типів: соматичні права та інформаційні права.

The concept of the generation of human rights, concrete historical conditions of formation and criteria for the classification of generations of human rights are revealed. The concept and essence of human rights of the fourth generation are described. It is shown that they are based on the independence of a person in choosing lawful behavior, which is based on the autonomy of a person within a single legal field, norms of morality and religion. It was determined that the human rights of the fourth generation can be reduced to two general types: somatic rights and informational rights.
