Запобігання та врегулювання конфлікту інтересів на державній службі

Abstract

У кваліфікаційній роботі узагальнено теоретичні дослідження вітчизняних та зарубіжних науковців з питань запобігання та врегулювання конфлікту інтересів, розглянуто морально-етичний та культурно-історичний аспекти даної проблеми. Ретроспективний аналіз антикорупційного законодавства дозволив визначити, що законотворчі процеси в цій сфері базувались на кращих нормах попередніх антикорупційних законів України, доповнюючи їх європейськими стандартами. Визначено, що сферами виникнення конфлікту інтересів може бути економічна, політична, кадрова, що дозволяє сприймати феномен конфлікту інтересів як норму суспільного життя, спрямовуючи при цьому зусилля на розробку та реалізацію механізмів його врегулювання. Проаналізовано роль та особливості діяльності основних антикорупційних інституцій в Україні. Дослідження сприйняття корупції в Україні продемонстрували, що переважна частина українців вважає дане явище однією з найбільших проблем, що заважає побудові сталої демократії в державі, а найбільш залученими до корупційних дій вважають керівників підприємств та бізнесменів. Аналіз реалізації рекомендацій, розроблених для України Transparency International, дозволив виявити невисокий ступінь їх виконання. Аналіз чинників, що гальмують реалізацію ефективної державної політики у сфері протидії корупції в Україні, а також врахування досвіду європейських країн, дозволив.

The qualification work summarizes the theoretical studies of domestic and foreign scientists on the prevention and settlement of conflicts of interest, and considers the moral-ethical and cultural-historical aspects of this problem. A retrospective analysis of the anti corruption legislation made it possible to determine that the law-making processes in this area were based on the best norms of the previous anti-corruption laws of Ukraine, supplementing them with European standards. It was determined that the spheres of conflict of interests can be economic, political, personnel, which allows us to perceive the phenomenon of conflict of interests as a norm of social life, while directing efforts to the development and implementation of mechanisms for its regulation. The role and peculiarities of the main anti-corruption institutions in Ukraine are analyzed. Studies of the perception of corruption in Ukraine have shown that the majority of Ukrainians consider this phenomenon to be one of the biggest problems that hinders the construction of a sustainable democracy in the country, and the leaders of enterprises and businessmen are considered to be the most involved in corrupt practices. Analysis of the implementation of the recommendations developed for Ukraine by Transparency International revealed a low degree of their implementation. The analysis of the factors inhibiting the implementation of an effective state policy in the field of anti-corruption in Ukraine, as well as taking into account the experience of European countries, allowed.
