Abstract

Гуторов О.І., Ковалів О.І. Теоретико-методологічні засади розвитку та інституціонального забезпечення трансформації земельних відносин в Україні. Розкрито теоретичні й методологічні засади інституціонального забезпечення трансформаційних процесів у здійсненні земельної реформи в Україні з урахуванням часових і просторових передумов, з’ясовано основні причинно-наслідкові аспекти формування нових земельних відносин в Україні, в тому числі на регіональному рівні, діагностовано інституціональні особливості землекористування як виду природокористування. Оцінено позитивні наслідки та виявлено прорахунки реформування земельних відносин в Україні, обґрунтовано тенденції та закономірності їх трансформацій, розглянуто окремі напрями стратегічного бачення подальшого інституціонального розвитку аграрного сектора економіки України, а також обґрунтовано алгоритм гіпотези інституціонального забезпечення розвитку ринкових земельних відносин в Україні. Удосконалено основні принципи інституціоналізації конституційної норми права власності Українського народу, діагностовано передумови завершення земельної реформи.

Gutorov O.I., Kovaliv O.I. Theoretical and methodological foundations of development and institutional support of land relations transformation in Ukraine. The theoretical and methodological foundations of institutional support of transformation processes in the implementation of land reform in Ukraine taking into account the temporal and spatial preconditions have been considered. The main cause and effect aspects of the formation of new land relations in Ukraine, including the regional level have been found out; the institutional features of land use as a type of nature management have been elucidated. The positive consequences have been estimated and the errors of land relations reform in Ukraine have been identified. The trends and regularities of their transformations have been substantiated; some directions of strategic vision of further institutional development of the agrarian sector of the Ukrainian economy have been considered; and the hypothesis algorithm for institutional support of land market relations development in Ukraine has been substantiated. The expediency of personification of the institutions of property right to a land plot as an objects of real estate and property right of the Ukrainian people as a natural object ensuring the differentiation of rights and liabilities as for land and nature management and the responsibilities for their rational use and protection as well as the corresponding revenues (incomes) as the main tools for realizing ecological and economic interests in the process of completing the land reform has been substantiated. The theoretical and methodological preconditions for lifting a moratorium on purchase and sale of the agricultural lands that, unlike the existing ones, are based on a complex correction of the errors of land denationalization and the constitutional norms institutionalization regarding the land and its natural resources have been improved. The theoretical and methodological foundations of the institutional support for the completion of the land reform in Ukraine as a new paradigm have been formulated. These foundations are based on the institutionalization of the constitutional norms regarding the land and its natural resources as a natural object of property rights of the Ukrainian people and the basic national wealth which is under special protection of the state. The methods of scientific evaluation of the specific causes and effects of the land and agrarian reforms implemented in Ukraine have been further developed. These methods are based on the profound reliable information and on practical experience of their implementation, which allowed identifying their negative results and formulating the basic principles of completion of the land reform as a new paradigm. The basic principles of the constitutional norm institutionalization of the Ukrainian people’s property right have been improved. The preconditions for the completion of the land reform have been found.

Раскрыты теоретические и методологические основы институционального обеспечения трансформационных процессов в осуществлении земельной реформы в Украине с учётом временных и пространственных предпосылок, выявлены основные причинно-следственные аспекты формирования новых земельных отношений в Украине, в том числе на региональном уровне, диагностированы институциональные особенности землепользования как вида природопользования. Оценены позитивные последствия и выявлены просчёты реформирования земельных отношений в Украине, обоснованы тенденции и закономерности их трансформации, рассмотрены отдельные направления стратегического видения дальнейшего институционального развития аграрного сектора экономики Украины, а также обоснован алгоритм гипотезы институционального обеспечения развития рыночных земельных отношений в Украине. Усовершенствованы основные принципы институализации конституционной номы права собственности Украинского народа, диагностированы предпосылки завершения земельной реформы.
