Особливості державної політики у сфері національних меншин (спільнот) України

Abstract

У статті проаналізовано теоретико-правові та нормативні засади регулювання державної політики у сфері національних меншин України. Визначено особливості та основні підходи до розуміння державної політики і національних меншин як правових категорій. Розглянуто основні засади державної політики у сфері національних меншин, а також послідовно проаналізовано конкретні цілі та принципи цієї державної політики, відповідні гарантії реалізації прав і свобод національних меншин. Встановлено, що саме цілі та принципи такої державної політики, а також окремі законодавчі гарантії захисту та реалізації прав і свобод членів національних меншин (спільнот) загалом утворюють вихідні засади сучасної державної політики у сфері національних меншин (спільнот). Констатовано законодавчу невизначеність заходів і гарантій захисту й реалізації прав і свобод осіб, які належать до національних меншин (спільнот), що не відповідає принципу правової визначеності, ускладнює правозастосування та не може ефективно забезпечити досягнення цілей державної політики у сфері національних меншин (спільнот). Встановлено, що цілі цієї державної політики також потребують уточнення та більшої деталізації, вони мають забезпечуватись чітким організаційно-правовим механізмом їх реалізації. Обґрунтовано, що державна політика у сфері національних меншин (спільнот) має передбачати широку дієву участь держави у збереженні автентичності національних меншин (спільнот), зокрема невиключно через надання їм релевантної державної підтримки та гарантій, не допускаючи при цьому втручання у внутрішні питання життєдіяльності національних меншин (спільнот). Гарантування захисту й реалізації прав і свобод осіб, які належать до національних меншин (спільнот), сьогодні потребує напрацювання та фактичного впровадження державою за участі представників національних меншин (спільнот) комплексу конкретних заходів, спрямованих на підтримку й розвиток самобутності та ідентичності національних меншин (спільнот), їхню інтеграцію в українське суспільство.

The article analyzes the theoretical-legal and normative principles of state policy regulation in the sphere of national minorities of Ukraine. Features and main approaches to understanding state policy and national minorities as legal categories are defined. The key principles of state policy in the field of national minorities are considered, and the specific goals and principles of this state policy, corresponding guarantees of the realization of the rights and freedoms of national minorities are consistently analyzed. It has been established that the goals and principles of such state policy, as well as separate legislative guarantees for the protection and realization of the rights and freedoms of members of national minorities (communities) as a whole form the basic principles of modern state policy in the field of national minorities (communities). The legislative uncertainty of measures and guarantees for the protection and realization of the rights and freedoms of persons belonging to national minorities (communities) was noted, which does not correspond to the principle of legal certainty, complicates law enforcement and cannot effectively ensure the achievement of the goals of state policy in the field of national minorities (communities). It was established that the goals of this state policy also need clarification and more detail, they should be provided with a clear organizational and legal mechanism for their implementation. It is substantiated that the state policy in the field of national minorities (communities) should provide for the broad effective participation of the state in preserving the authenticity of national minorities (communities), in particular, not exclusively by providing them with relevant state support and guarantees, while not allowing interference in the internal issues of the life of national minorities (communities). Guaranteeing the protection and realization of the rights and freedoms of persons belonging to national minorities (communities) today requires the development and actual implementation by the state with the participation of representatives of national minorities (communities) of a set of specific measures aimed at supporting and developing the identity and identity of national minorities (communities), their integration into Ukrainian society.
