Abstract

Проаналізовано правове забезпечення оренди землі в Україні та стан орендних відносин на землях сільськогосподарського призначення. Надано пропозиції щодо правового вдосконалення та економічного врегулювання питань оренди земельних ділянок громадян та земель, що перебувають у державній чи комунальній формах власності, та надаються в оренду на конкурентних засадах через систему аукціону. Запропоноване комплексне вирішення питання раціонального та ефективного використання земель сільськогосподарськими підприємствами на умовах оренди.

Проанализированы правовое обеспечение аренды земли в Украине и состояние арендных отношений на землях сельскохозяйственного назначения. Даны предложения по правовому совершенствованию и экономическому урегулированию вопросов аренды земельных паёв граждан и земель, находящихся в государственной или коммунальной форме собственности, которые предоставляются в аренду на конкурсной основе через систему аукциона. Предложенное комплексное решение вопроса рационального и эффективного использования земель сельскохозяйственными предприятиями на условиях аренды.

The legal support of land lease in Ukraine and the state of lease relations on agricultural lands are analyzed. Proposals for legal improvement and economic regulation of land lease (shares) of citizens and lands in state or communal ownership and leased on a competitive basis through the auction system are provided. A comprehensive solution to the issue of rational and efficient use of land by agricultural enterprises on lease terms is proposed. The aim of the study. The purpose of the article is to analyze the current state of lease relations on agricultural land, to identify ways to improve the legal framework for regulating land lease in order to form a competitive market player. Research methods. The methodological basis of the study is a set of methods of scientific knowledge, namely logical, system-structural and others. Results of work. In order to further improve the economic and legal regulation of lease relations on agricultural land, we offer. In the Law of Ukraine "On Land Lease" it is necessary to determine the minimum rent rates for the purpose of social protection of owners of land shares (units), to prescribe the obligation of compliance of the lease agreement with the project of ecological and economic substantiation of crop rotations and land management. In the land lease agreement must determine the liability of the parties for breach of contract, the list of crops to be grown on leased land, set minimum lease terms, taking into account crop rotation and the obligation to conduct annual indexation of rent. To introduce economic incentives for tenants to independently carry out measures for the rational use and protection of land (exemption from land tax, the provision of various benefits in the form of subsidies); investing agricultural producers in the creation and expansion, reconstruction or technical re-equipment of fixed and related working capital; increasing the level of rent due to the development and strengthening of medium-sized businesses; adoption at the state level of the relevant national regulatory policy for the agricultural sector of the economy, which should be mandatory for implementation and planning for at least 25 years.
