Державний орган з фінансових розслідувань: роль та засади функціонування

Abstract

В статті окреслено передумови створення та засади функціонування державного органу з виявлення, розслідування, розкриття припинення та запобігання кримінальних правопорушень у сфері фінансово- господарської діяльності юридичних та фізичних осіб. Запропоновано назву нового органу – Національне бюро фінансових розслідувань України. Обґрунтовано, що створенню Бюро повинне передувати оновлення Концепції фінансової безпеки України. Окреслено такі основні засади функціонування Національного бюро фінансових розслідувань: прозорий відбір керівництва та контроль його діяльності, виконання, у першу чергу, аналітичних функцій, з метою запобігання фінансових злочинів, сучасний мотиваційних механізм, формування системи розвитку персоналу, громадський контроль.

The prerequisites for the creation and basis of functioning of the state body for the detection, investigation, disclosure of termination and prevention of criminal offense in the sphere of financial and economic activity of legal entities and individuals were considered in the article. The name of the new body, the National Bureau of Financial Investigation, was proposed. The establishment of the Bureau should precede the update of the Financial Security Concept of Ukraine was substantiated. The basic principles of functioning of the National Bureau of Financial Investigation are outlined: transparent selection of management and control over its activity, performing, first of all, analytical functions for the prevention of financial crimes, modern motivational mechanism, formation of personnel development system, public control.
